Ontario Small Claims Court Limit Increases to $50,000
Effective October 1, 2025, the monetary jurisdiction of Ontario’s Small Claims Court will increase from $35,000 to $50,000, as stipulated in Ontario Regulation 42/25. This significant change enhances access to justice by allowing more individuals and businesses to resolve disputes in a more cost-effective and efficient forum.
Amending O. Reg. 626/00
(small claims court jurisdiction and appeal limit)
1. Section 1 of Ontario Regulation 626/00 is amended by striking out “$35,000” wherever it appears and substituting in each case “$50,000”.
2. Section 2 of the Regulation is amended by striking out “$3,500” wherever it appears and substituting in each case “$5,000”.
Commencement
3. This Regulation comes into force on the later of October 1, 2025 and the day this Regulation is filed.
Understanding the Change
Previously, claims exceeding $35,000 required initiation in the Superior Court of Justice, often leading to higher costs and longer timelines. With the new $50,000 threshold, many disputes can now be addressed within the Small Claims Court, which is designed to be more accessible and less formal.
Implications for Existing and New Claims
If you have an ongoing claim in Small Claims Court or are considering initiating one, it’s crucial to assess how this change affects your case:
- Existing Claims: You may be eligible to amend your claim to reflect the new limit. However, proper legal procedures must be followed to avoid delays or dismissals.
- New Claims: Disputes previously deemed too substantial for Small Claims Court may now fall within its jurisdiction, offering a more streamlined path to resolution.
Consulting with a licensed paralegal can ensure that your claim is appropriately filed and that you maximize the benefits of this regulatory change.
